This is the last Will and Testament of me Christopher Metcalfe of West Burton in the parish of Aisgarth in the county of York Yeoman made this twelfth day of August in the year of our Lord one thousand eight hundred and forty eight in manner following - that is to say I give and devise unto my eldest son John Metcalfe of Ashton under Lyne in the county of Lancaster Gentleman and my son in law George Broderick of West Burton aforesaid Farmer their heirs assigns all my messuage lands tenements and hereditaments situate at Stalling Busk in the parish of Aisgarth aforesaid and also all my real estates wheresoever else situate to hold the same unto and to the use of the said John Metcalfe and George Broderick their heirs and assigns But upon the Trusts hereinafter expressed of and concerning the same - that is to say upon Trust that the said John Metcalfe and George Broderick and the survivors of them and the heirs of such survivors do and shall with all convenient speed after my decease sell and dispose of my said real estates either by public auction or private contract unto any person or persons who shall be willing to become the purchaser or purchasers thereof and for the most money that can be reasonably obtained fromt he same and I direct and declare that the said John Metcalfe and George Brodrick their heirs executors or administrators shall and do stand possessed of all moneys to arise from such sale shall be made and completed upon the Trusts hereinafter next mentioned - that is to say upon Trust in the first place to pay all my Debts funeral and testamentary expences and upon further Trust after such payments as aforesaid as to one equal fifth part or share thereof In Trust for all and every the children of my late daughter Betty Hutchinson deceased share and share alike and as to the remaining four equal fifth parts or shares thereof In Trust for my said son John Metcalfe my other sons James Pearson Metcalfe and Edward Metcalfe and my daughter Jane Brodrick share and share alike I give and bequeath my two kitchen arm Chairs and Cushions thereto my black oak box and my small Wood box unto my said daughter Jane Brodrick absolutely I give and bequeath my Oak Book Case and Desk unto my granddaughter Elizabeth Brodrick absolutely I give and bequeath my best bed bedstead Bedding and Hangings and my Oak dining Table unto my grand daughter Jane Ann Brodrick absolutely I give and bequeath all the rest residue and remainder of my personal estate and effects whatsoever and wheresoever and not hereinafter by me specifically bequeathed unto my five grand daughters the children of my said daughter Betty Hutchinson deceased share and share alike asolutely and I hereby declare that the receipt or receipts in writing of the said John Metcalfe and George Brodrick or of either of them or their heirs executors or administrators of the survivor of them shall effectively discharge the purchase or purchasers of my said real estates of and from so much of the purchase money as shall in such receipt or receipts be expressed to be received and that such purchase or purchasers after taking such receipt or receipts shall not be answerable or accountable for any loss misapplication or nonapplication of such purchase money or purchase moneys or any part thereof and I nominate and appoint my said son John Metcalfe and my said son in law George Brodrick joint Executors of this my Will and I declare that they and their respective heirs executors or administators shall not be answerable or accountable the one for the other of them nor shall be charged or chargeable with or answerable for the acts neglects or defaults of the other of them but each of them for his own acts receipts neglects and defaults only nor for any money but such only as they shall respectively actively receive by virtue of this my will nor for any involuntary losses and that they respectively shall be allowed and may retain out of the said Trust estates moneys and premises all their costs charges damages and expences to be occasioned by the execution of the trusts hereby in them reposed and revoking all former Wills by me I declare this instrument in writing to be my Last Will and Testament in witness whereof I have hereunto set my hand and seal the day and year first above written

The second day of May 1850 John Metcalfe and George Brodrick the Executors in this Will named were sworn in Common form and they further made Oaths that the personal Estate and Effects of the Testator within the Archdeaconry of Richmond were under the value of two hundred pounds
