This Indenture of Three parts made the tenth day of March in the Thirtieth year of the reign of our Sovereign Lord King George the third and in the year of our Lord One Thousand seven hundred and ninety. Between Ann Spenceley of Carperby in the County of York Widow Robert Terry of Aysgarth in the County of York Badger and Ellen otherwise Eleanor his wife Christopher Terry of Aysgarth aforesaid Yeoman eldest son and heir at law of the said Robert and Eleanor and James Temple of Aysgarth aforesaid Badger son and heir at law of George Temple late of Aysgarth husbandman deceased and which the said Ann and Eleanor are also daughters of the said late George Temple of the first part Richard Jackson of Northallerton in the same County Mercer Draper and Flax drefser George Lowson of Aysgarth aforesaid weaver and John Rodick of Richmond in the same County Linen Draper of the second part and James Croft and Michael Croft both of Aysgarth aforesaid Masons of the third part Whereas the said George Temple in his life being seized or pofsessed of or intitled to a mefsuage or tenement piece or parcel of Ground Garth or Garden at Aysgarth aforesaid did by Indenture bearing date on or about the eighth day of August which was in the year of our Lord One Thousand seven hundred and sixty five Grant bargain sell alien enfeoff and confirm the same to his two daughters the said Ann and Eleanor the heirs and afsigns for ever And Whereas before the date and execution of the Indenture next hereinafter recited the same Tenements and Hereditaments with the appurtenances were contracted for and sold to the said James Croft and Michael Croft at and for the price or sum of twenty eight pounds And Whereas by Indenture of three parts bearing date on or about the seventh day of September now last past made or mentioned to be made between the said Ann Spenceley of the first part the said Richard Jackson George Lowson and John Rodick of the second part and the several other persons whose names are hereunto subscribed Creditors of the said Ann Spenceley of the third part Reciting that the said Ann Spenceley was indebted to the several persons therein mentioned to be of the third part whose names are thereunto subscribed in the several sums of money set opposite to their respective names which she was desirous to pay but not being able so to do agreed to make such afsignment as thereinafter mentioned It is witnefsed that in Consideration of ten shillings by the said Richard Jackson George Lowson and John Rodick to the said Ann Spenceley paid She the said Ann Spenceley did grant bargain sell afsign transfer and set over unto the said Richard Jackson George Lowson and John Rodick their executors Administrators and Afsigns All the Mefsuage Cottages Lands Tenements and hereditaments whatsoever of her the said Ann Spenceley or whereof or wherein she had any estate right title or interest with there and every of [there ] members and Appurtenances situate at Carperby aforesaid or elsewhere To hold the same to the said Richard Jackson George Lowson and John Rodick their executors Administrators and Afsigns from thenceforth for one thousand years under the rent of a pepper corn Upon the Trusts and for the intents and purposes thereinafter mentioned exprefsed and declared as in and by the said in part alloted Indentures reference being thereunto had may and will and more fully at large apprehend And whereas the said James Croft and Michael Croft as also the said Ann Spenceley are desirous and the said Richard Jackson George Lowson and John Rodick are willing that such contract Sale or Agreement shall be carried into execution for which purpose the said Ann Spenceley hath prevailed on the said Robert Terry and Eleanor his wife Christopher Terry and James Temple to join in a Conveyance Now this Indenture witnefseth that for and in consideration of the sum of twenty eighth pound of lawful money of Great Britain by the said James Croft and Michael Croft to the said Richard Jackson George Lowson and John Rodick (at the request and by the direction of the said Ann Spenceley Robert Terry and Eleanor his wife Christopher Terry and James Temple by their being parties to and executing these presents) in hand paid at or before the sealing and delivery hereof the receipt whereof they the said Richard Jackson George Lowson and John Rodick to hereby acknowledge and of the sum of ten shillings apiece of like lawful money by the said James Croft and Michael Croft to the said Ann Spenceley Robert Terry and Eleanor his wife Christopher Terry and James Temple severally in hand paid at or before the sealing and delivery hereof the receipt whereof is hereby acknowledge they the said Richard Jackson George Lowson and John Rodick Have and each and every of them Hath bargained sold and released and by these presents Do and each of them Doth bargain sell and release And the said Ann Spenceley Robert Terry and Eleanor his wife Christopher Terry and James Temple Have and each and every of them Hath according to their respective Estates Rights and Interests therein granted bargained sold released enfeofed ratified and confirmed and by these presents Do and each and every of them Doth grant bargain sell release enfeoff ratify and confirm unto the said James Croft and Michael Croft their Heirs and Afsigns All that Mefsuage Tenement or Dwelling house with the outbuildings Yard Garth Garden or parcel of ground and their appurtenances thereunto belonging situate lying and being at Aysgarth aforesaid and now in the pofsetion Tenure Occupation of the said James Croft and Michael Croft or the one of them or the one of their Afsigns or Underteneants adjoining on a Mefsuage or dwelling house late of the said George Temple on or towards the east on a stable or turf house now or late of Michael Wilson on or towards the west and on the town street of Aysgarth aforesaid on or towards the south. Together with all and singular houses outhouses edifices buildings yards Backsides Ways Paths pafsage waters watercourses commons common of pasture moor and turbary liberties profits priveledges Advantages Easements hereditaments rights members and Appurtenances whatsoever to the said mefsuages tenement garth and premises or any of them or any parts thereof belonging or in any wise appertaining or to be with the same or any part thereof now or commonly demised used or occupied or enjoyed or accepted reputed deemed taken or known to be part parcel or member theretofore belonging thereto or to any part thereof. And the reversion and reversions remainder and remainders yearly and other rents ifsues and profits thereof And all the Estate Right Title Interest Use Trust posefsion Equity and right of redemption property Claim and demand whatsoever both at law and in Equity of them the said Ann Spenceley Robert Terry and Eleanor his wife Christopher Terry James Temple Richard Jackson George Lowson and John Rodick either or any of them of or to out of the said mefsuage tenement and premises or any of them or any part thereof And also all deeds Evidence and writings whatsoever relating to or in any wise concerning the same tenements and premises now in the hands custody or power of the said Ann Spenceley Robert Terry and Eleanor his wife Christopher Terry James Temple either or any of them or which they either or any of them can procure or come by without suit To have and to hold the said mefsuage Tenement or dwelling house yard garth garden or parcel of ground and all and singular other the premises above mentioned and intended to be hereby released and conveyed with their and every of their Rights Members and Appurtenances unto the said James Croft and Michael Croft their Heirs and Afsigns To the only proper use and behoof of the said James Croft and Michael Croft their Heirs and Afsigns for and to and for no other use intent or purpose whatsoever And the said Richard Jackson George Lowson and John Rodick do hereby for themselves severally and respectively and not jointly or one for the others or other of them but each of them for himself severally and for his own several and respective Heirs Executors and Administrators acts and deeds only covenant promise and agree to and with the said James Croft and Michael Croft their Heirs and Afsigns that they the said Richard Jackson George Lowson and John Rodick have not nor hath any of them made done committed or knowingly suffered any act deed matter [ ] or thing whatsoever whereby or by reason or means whereof the said tenements and premises above mentioned and intended to hereby released and conveyed or any of them or any part thereof [one is can] shall or may be in[ ] charged or encumbered in Estate or Title charge or otherwise And the said Ann Spenceley for herself her Afsigns and Administrators the said Robert Terry for himself and the said Eleanor his wife his her and their Heirs Executors Administrators the said Christopher Terry for himself his Heirs Executors Administrators and the said James Temple for himself his Heirs Executors Administrators do and doth hereby covenant promise and agree to and with the said James Croft and Michael Croft their Heirs and Afsigns in manner and form following that is to say that they the said James Croft and Michael Croft their Heirs and Afsigns shall and may from time to time and at all times hereinafter and quietly have and use occupy pofsefs and enjoy all and singular the said Mefsuage Tenement Yard Garth or Garden and all other the premises above mentioned and intended to be hereby released and conveyed with their and every of their Rights Members and Appurtenances without any lawful let suit trouble hindrance molestation interruption or disruption whatsoever of from or by the said Ann Spenceley Robert Terry and Eleanor his wife Christopher Terry and James Temple either or any of them their either or any of their Heirs Executors Administrators or any other person or persons whomsoever claiming or to claim by from or under them or any of them or by from or under the said George Temple deceased or any of his ancestors And also that they the said Ann Spenceley Robert Terry and Eleanor his wife Christopher Terry and James Temple and their Heirs and all and every other person and persons whomsoever having or lawfully or equitably claiming or who shall or may hereafter have or so claim any Estate Right Title Trust or Interest of in to or out of the said Mefsuage Tenement and premises or any part thereof by from or under them or any of them or by from or under the said George Temple deceased or any of his ancestors of his shall and will be at all times hereafter upon the reasonable request and at the proper costs and charges in the Law of the said James Croft and Michael Croft their Heirs and Afsigns make and do acknowledge levy execute and suffer or cause and procure to be made done acknowledged levied executed and suffered all and every such further and other lawful and reasonable Acts Deeds Conveyances and Afsurances in the Law whatsoever for the further better more perfect absolute and efficient conveying afsuring and confirming the same Mefsuage Tenement hereditaments and all and singular other the premises with the Appurtenances unto the use of the said James Croft and Michael Croft their Heirs and Afsigns for ever by them or either of them their or either of their Heirs or Afsigns or their or either of their Councel learned in the Law shall be reasonably advised or devised and required In witnefs whereof the parties first above mentioned have to these presents interchangeably set their hands and seals the day and year first above written.
